The following terms and conditions apply to services and offers provided by AFXLABS. By ordering services from AFXLABS you are agreeing to the following terms and conditions. If AFXLABS enters into a specific written agreement with you then the details of that agreement will determine the nature of representations of that particular agreement relating to payments, deliverables etc.
· We reserve the right to refuse to any of our free services and offers which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright.
· We provide free domain and hosting only for projects which we consider eligible for using these offers, Though AFXLABS reserve all rights to discontinue any of the free domain and hosting services without any prior notice to the clients or any of the public domain entity.
· Clients using free offers and services will not be provided any of the private details regarding the domain and hosting such as login and other account access information until AFXLABS provides free technical support, Though AFXLABS can provide this detail on its mutual understanding with the client authority on written agreement. AFXLABS reserves all rights to discontinue use of such information and account access at any time.
· Client request for login and panel details will only be provided if the client agree with the written agreement of discontinuing our 1 year free technical support for web based applications and software’s.
· Any change or modification done in the software or application by the client itself, any public domain member, or other company without written permission from AFXLABS authority will lead to any offensive and illegal activity. AFXLABS reserves right to discontinue any of the service provided by us and take legal action.
· If client refuses to take our free offers and services regarding website development or any other service then the cost estimated for the project will not be reduced with effect of no use of our free services.
Software License Agreement
WITH THE INSTALLATION AND/OR USE OF OUR SOFTWARE, CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT AND LIMITED WARRANTY (The "Agreement").
BY INSTALLING OR USING OUR SOFTWARE YOU INDICATE YOUR ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT ACCEPT OR AGREE WITH THESE TERMS, YOU MAY NOT INSTALL OR USE OUT SOFTWARE!
1. Introduction. This agreement explains when and how you may use both Registered and Shareware Copies of OUR SOFTWARES
In this agreement:
* " OUR SOFTWARES " means the SOFTWARE you have purchased or obtained for evaluation, including both the control software and the associated documentation and other materials.
*”Registered Copy" means a copy of the SOFTWARE application purchased from us or an approved vendor.
*”we" or "us" means Afxlabs Division of -A- stealth technology.
*”you" means the end user of OUR SOFTWARES.
2. Legal Agreement. This is a legal agreement which allows you, the end user, to use OUR SOFTWARES under certain terms and conditions. If you cannot agree to abide by the terms of this agreement you should not use ANY OF OUR SOFTWARES.
A. You may not redistribute OUR SOFTWARES without advanced written permission from Afxlabs.
B. You agree to not distribute other controls total or partially based ON OUR SOFTWARES.
C. You agree to not modify the binary code OF OUR SOFTWARES.
If you have the registered copy of OUR SOFTWARES you may use them within your own Commercial Applications or non-Commercial usage keeping Privacy of others in mind.
You assume full responsibility for the selection and use of OUR SOFTWARES to achieve your intended results.
3. Copying Registered Copies of OUR SOFTWARES when you receive a Registered Copy of OUR SOFTWARES you may make copies of software which are necessary for normal backup purposes. You agree not to make any other copies of the software, or any part of them, or sell or give any copies to others, without our advance written permission.
A. You may not redistribute controls derived from OUR SOFTWARES without advanced written permission from Afxlabs.
B. You agree to treat the license for OUR SOFTWARES like a book, negating the possibility that two people may use your registered Copy simultaneously.
You can provide Evaluation copy without asking any FEE for that cause.
4. LIMITED WARRANTY: The following limited warranty applies to Registered Copies of OUR SOFTWARES. It is included here so you understand what your warranty will be when you purchase a Registered Copy. This warranty does NOT apply to Shareware Copies of OUR SOFTWARES.
Bugs and Program Errors. We do not promise that OUR SOFTWARES will be free of bugs or program errors. If you report a program error or bug to us, we will use our best efforts to correct it. If we issue a maintenance release for OUR SOFTWARES which includes a correction for an error you reported, we will send you a copy of that maintenance release at no charge if applicable at your request. We will only do this for maintenance releases, not for new major releases or other new versions of OUR SOFTWARES.
5. Disclaimers and Limitations.
Disclaimer for Shareware Copies: You are not paying for the use license for your Shareware Copy of OUR SOFTWARES. Accordingly the Shareware Copy is provided "AS-IS" and without warranty of any kind.
Disclaimer for Registered Copies: Except for the limited warranty stated above, we disclaim any and all other warranties, express or implied, oral or written, including any implied warranties of merchantability or fitness for a particular purpose. The limited warranty above gives you specific legal rights.
Limitation of Liability: In no event shall we be liable for any incidental, consequential, or punitive damages to your PC, Data whatsoever arising out of the use of OUR SOFTWARES or your relationship with us.
ALL DISPUTES ARE SUBJECT TO Gurgaon JURISDICTION ONLY.
